Contestants’ chances of winning will depend on the number of entries submitted.
This contest is open to all Canadian residents, 18 years of age or older, except employees of Fabricville, their advertising and promotional agencies, their independent organizations and members of their respective families and people domiciling with them.
By entering the contest, all participants accept the contest rules and decisions as final. By entering the contest, the contestant agrees to have their name, city of residence, and the photo of their garment available for viewing by the public at www.fabricville.com and allows Fabricville and their advertising and promotional agencies to use that information for internal use or for publicity purposes in any media without further compensation. All entry forms and photos become the property of Fabricville.
To become a winner, the selected participant must have read and complied with the contest rules in their entirety and agree to all terms and conditions. They must affirm that they created the garment that is the subject of the entry with no assistance from others. They must confirm that all information supplied in the entry is valid and correct.
Fabricville reserves the right to refuse and disqualify any incomplete or illegible entry, or any entry for which the garment does not correspond to any of the garment categories listed on the entry form, or includes images deemed offensive or inappropriate.
Total Grand Prize approximate retail value of $4,000.00 is based on departure from Halifax, Nova Scotia. Actual retail price may vary depending on city of departure. Grand Prize retail value may range from $2,700.00 to $4,500.00.
Fabricville does not share rent or sell personal information submitted, however, once the information is posted on-line, Fabricville cannot be held responsible for third party use or applications of posted information.
Fabricville is not responsible for lost, late, misdirected, mutilated of postage due mail, email or electronic transmissions of entry forms, for any problems or technical malfunction of any computer, online systems services, servers or providers, computer equipment, software of any email or entry to be received by Fabricville on account of technical problems or traffic congestion on the internet or at any web site, any combination thereof or otherwise including any injury or damage to entrants, or any other person’s computer related to or resulting from participation in or downloading of any materials in the contest.
Winners will receive their prize at a pre-determined Fabricville store location of their choice. Prizes are not transferable, not redeemable for cash value or substituted for other items. Fabricville reserves the right to substitute a prize of equal or greater value due to prize availability.
The deadline for claiming the Grand Prize and the Finalists’ prizes is April 30, 2011.
In order to claim the Grand Prize, the winner and his/her travel guest must (i) each have valid travel documents prior to ticketing; (ii) have at least one major credit card in good standing; (iii) claim the Grand Prize and travel at any time between February 21, 2011 to February 21, 2012, excluding Canadian national or provincial holidays, peak seasons, and any other blackout periods which may apply (such as New Year’s Eve, New Year’s Day, Christmas, Spring Break, Easter, Labour Day, etc.) and for five days before or after such periods; (iv) contact Fabricville to proceed to the booking at least four (4) weeks prior to the departure date; (v) the selected winner and travel guest must execute a full release and affidavit of eligibility in a form to be provided by Fabricville which relieves Fabricville from any and all liability for injury associated with any prize awarded to the winner.
Bookings will be subject to airline carrier availability in economy class. Contest entrants hereby acknowledge that some gateway(s) may not have available charter flights during certain periods of time. Travel departures and returns will occur through the same Canadian international airport gateway. All travel must be completed by February 21, 2012. Once booked, a reservation may not be rescheduled or substituted. Some additional restrictions may apply.
The Grand Prize winner shall be responsible for (i) all ground transfers between the winner’s and/or travel guest’s residences and departure airport; (ii) all Canadian and Federal taxes, airport and departure taxes, baggage costs, transfers, insurance, items of personal nature, meals and beverages, gratuities, and additional accommodations or excursions, and all other costs not specifically stated as included herein. No frequent flyer miles will be available for this trip. In the event that the winner does not use any portion of the Grand Prize, there will be no extension, no transfer, substitution or any kind of compensation provided.
In no event shall Fabricville be held liable for any delays or cancellations of the Grand Prize trip due to inclement weather or any other circumstances beyond their reasonable control.
Fabricville is not responsible for losses, damages, rights, claims and actions of any kind in connection with their contest. Contest entrants assume all liability for injuries caused or claimed to be caused by participation in this Contest, or the use or misuse of any prize granted herein, including any losses, damages, claims, actions and causes of action with respect to any prize so granted, including and without limitation, all liability and risks in connection with travel. Without limiting the generality of the foregoing, by entering this Contest, entrants release and forever discharge Fabricville, and its agents, advisors, employees, officers and directors, shareholders and representatives, from any and all damages, rights, claims and actions of any kind whatsoever arising in connection with the Contest or resulting from acceptance, possession or use or misuse of any prize awarded in connection with the contest, including without limitation personal injury, death and/or property damage as well as claims based on publicity rights, defamation or invasion of privacy.
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
